1. Acceptance of Terms

By accessing or using SelamGPT's API services and platform ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms constitute a legally binding agreement between you and SelamGPT Inc. ("SelamGPT," "we," "us," or "our").

2. Description of Services

SelamGPT provides AI language model API services specializing in Ethiopian languages including Amharic, Oromo, and Tigrinya. Our Services include:

• Chat completion APIs for conversational AI
• Text-to-speech (TTS) services
• Voice agent capabilities
• Translation services for Ethiopian languages
• Image generation and editing
• OCR and file processing
• Web search integration
• Batch processing capabilities

3. Account Registration

To use our Services, you must:

• Create an account using OAuth authentication (Google or GitHub)
• Provide accurate and complete information
• Be at least 13 years of age
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. API Keys and Authentication

Upon registration, you will receive API keys to access our Services. You agree to:

• Keep your API keys confidential and secure
• Not share API keys with unauthorized parties
• Rotate keys immediately if compromised
• Use API keys only for authorized purposes
• Accept responsibility for all usage under your API keys

5. Service Tiers and Usage Limits

5.1 FREE Tier ($0/month)

• Selam-Turbo & Selam-Thinking models (text + vision)
• Selam-Image-Turbo (fast image generation)
• TTS: 5 audio minutes per day
• 1 concurrent request
• Community support
• 24-hour request log retention

5.2 BETA Tier ($15/month)

• Everything in FREE, plus:
• Selam-Plus & Selam-Coder (premium models)
• Selam-Search (web search integrated)
• Selam-Image (standard image generation)
• Direct provider model access
• TTS: 15 audio minutes per day
• 2 concurrent requests
• Email support
• 24-hour request log retention

5.3 PRO Tier ($25/month)

• Everything in BETA, plus:
• Selam-Image-Pro (premium image generation)
• Higher rate limits across all APIs
• TTS: 40 audio minutes per day
• 5 concurrent requests
• Priority email support
• 30-day request log retention

6. Acceptable Use Policy

You agree NOT to use our Services to:

• Generate illegal, harmful, or abusive content
• Violate intellectual property rights
• Impersonate others or misrepresent your identity
• Distribute malware, viruses, or harmful code
• Engage in fraudulent activities
• Harass, threaten, or harm others
• Scrape or reverse engineer our Services
• Bypass rate limits or security measures
• Generate spam or unsolicited communications
• Create deepfakes or misleading content without disclosure
• Violate any applicable laws or regulations

7. Rate Limits and Throttling

We enforce rate limits based on your service tier to ensure fair usage and system stability. Exceeding rate limits may result in temporary throttling or suspension. Rate limits are subject to change with notice.

8. Payment and Billing

For paid tiers:

• Fees are billed monthly in advance
• All fees are non-refundable unless required by law
• You authorize us to charge your payment method
• Prices may change with 30 days' notice
• Failure to pay may result in service suspension
• You are responsible for all applicable taxes

9. Intellectual Property

9.1 Our IP

SelamGPT retains all rights to our platform, API, models, documentation, and related intellectual property. You may not copy, modify, or create derivative works without permission.

9.2 Your Content

You retain ownership of content you input into our Services ("Input") and content generated by our Services ("Output"). You grant us a license to use Input to provide Services and improve our models. You are responsible for ensuring you have rights to use any Input.

9.3 Output Usage

Subject to these Terms, you may use Output for any legal purpose. However, Output may not be unique, and other users may receive similar results. We do not claim ownership of Output.

10. Data Privacy and Security

Our collection and use of your data is governed by our Privacy Policy. We implement security measures to protect your data, but cannot guarantee absolute security. You are responsible for securing your own systems and data.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may:

• Perform scheduled maintenance with notice
• Experience unexpected downtime
• Modify or discontinue features
• Suspend service for violations or non-payment

12. Disclaimers and Limitations

12.1 AI Limitations

Our AI models may produce inaccurate, biased, or inappropriate content. You acknowledge that:

• Output should be reviewed before use
• Models may reflect biases in training data
• Accuracy is not guaranteed
• Output may not be suitable for all purposes

12.2 Warranty Disclaimer

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELAMGPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless SelamGPT from any claims, damages, losses, or expenses (including legal fees) arising from your use of Services, violation of these Terms, or infringement of third-party rights.

15. Termination

Either party may terminate this agreement:

• By You: Delete your account at any time
• By Us: For violations, non-payment, or at our discretion with notice

Upon termination, your access will cease, and we may delete your data per our retention policy. Provisions that should survive termination will remain in effect.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notice. Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using our Services.

17. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between parties
• Severability: Invalid provisions do not affect remaining Terms
• Waiver: Failure to enforce rights does not waive them
• Assignment: You may not assign these Terms without our consent
• Force Majeure: We are not liable for delays due to circumstances beyond our control
